Consumer Health Data Privacy Policy

Scope of This Policy

This Consumer Health Data Privacy Policy ("Health Data Policy") describes how ESA Registration ("we," "us," or "our") collects, uses, shares, and protects "consumer health data," and the rights you have with respect to that data. It is a separate, standalone policy that supplements our general Online Privacy Policy. Where this Health Data Policy and our general Online Privacy Policy conflict with respect to consumer health data, this Health Data Policy controls.

This Health Data Policy is provided to comply with Washington's My Health My Data Act and similar consumer health data laws. "Consumer health data" means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. Because we provide emotional-support-animal evaluation letters that relate to a consumer's mental-health condition, some of the information we collect is consumer health data.

Categories of Consumer Health Data We Collect

Depending on the services you request, we may collect the following categories of consumer health data:

  • Information indicating that you are seeking or have obtained an emotional-support-animal evaluation or letter, including the fact that you requested a mental-health-related evaluation.
  • Mental- and physical-health information you provide during an assessment or intake, such as symptoms, stressful or significant life events, conditions affecting your daily activities, current medications, and the name of a treating physician or provider.
  • Information about your interactions with a licensed mental-health professional through our services (for example, that an appointment was scheduled or that an evaluation was completed).
  • Information that you provide about your emotional support animal in connection with a health-related evaluation.
  • Identifiers and technical data — such as your name, email address, account identifier, IP address, and approximate location — when they are linked to the health-related information above.

We collect this data directly from you when you register, complete an assessment or intake form, communicate with us, or use our services. We do not knowingly collect consumer health data from children.

Purposes for Which We Collect Consumer Health Data

We collect and use consumer health data only for the following purposes:

  • To provide the service you requested. Our primary purpose for collecting consumer health data is to provide the emotional-support-animal evaluation, letter, and related services that you have asked us to provide, including connecting you with a licensed professional and delivering your documents.
  • To create and maintain your account and to authenticate you.
  • To communicate with you about your request, your order, scheduling, and customer support.
  • To process payments for the services you request.
  • To maintain records, prevent fraud and misuse, ensure the security of our services, and comply with our legal obligations.

We do not use consumer health data for targeted advertising, and we do not use it for purposes that are incompatible with the purposes described above without first obtaining your consent.

How and With Whom We Share Consumer Health Data

We do not sell consumer health data. We may share consumer health data only in the following limited circumstances:

  • Licensed professionals. We share the information necessary to fulfill your request with the licensed mental-health professional who performs your evaluation. That professional's handling of your information is governed by their own legal and professional obligations and privacy practices.
  • Service providers and processors. We share consumer health data with vendors that process data on our behalf and under our instructions — for example, payment processors, email and communication providers, scheduling tools, hosting and infrastructure providers, and customer-support tools — solely to provide the services you requested. These processors are contractually limited to using the data only for the purposes we specify.
  • Affiliates. We may share consumer health data with our corporate affiliates that provide or support the services you requested, subject to the same restrictions described in this Health Data Policy.
  • Legal and safety reasons. We may disclose consumer health data when required to comply with a valid legal obligation, to respond to lawful requests from public authorities, to enforce our agreements, or to protect the rights, safety, or property of you, us, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, consumer health data may be transferred as part of that transaction, subject to the protections described in this Health Data Policy.

We do not share consumer health data with any third party for that third party's own independent purposes except with your consent or as required by law.

We Do Not Sell Personal Information or Consumer Health Data

We do not sell your personal information or your consumer health data. We will not sell consumer health data without first obtaining your separate, valid authorization that is distinct from any consent obtained for the collection or use of the data, as required by Washington's My Health My Data Act. Any such authorization would describe the specific health data to be sold, the purchaser, and the purpose, and you would be free to refuse or to revoke the authorization at any time.

Your Rights

Subject to applicable law, you have the following rights with respect to your consumer health data:

  • Right to access. You may request confirmation of whether we are collecting, sharing, or selling your consumer health data, and request access to that data, including a list of the third parties and affiliates with whom we have shared it.
  • Right to delete. You may request that we delete your consumer health data. Upon a verified request, we will delete the data from our records and direct our service providers and affiliates to do the same, except where retention is permitted or required by law.
  • Right to withdraw consent. Where we rely on your consent to collect or share consumer health data, you may withdraw that consent at any time. Withdrawing consent does not affect the lawfulness of processing that occurred before withdrawal, and it may mean we can no longer provide certain services to you.
  • Right against discrimination. We will not discriminate or retaliate against you for exercising any of these rights.

How to Exercise Your Rights

To exercise any of the rights described above, contact us at [email protected]. We will take steps to verify your identity before acting on your request and will respond within the timeframes required by applicable law. You may also designate an authorized agent to make a request on your behalf, subject to verification. If we deny your request, we will explain why and tell you how to appeal that decision.

Data Retention and Security

We retain consumer health data only for as long as necessary to provide the services you requested and to meet our legal, accounting, and recordkeeping obligations, after which we delete or de-identify it. We maintain reasonable administrative, technical, and physical safeguards designed to protect consumer health data against unauthorized access, use, or disclosure.

Changes to This Policy

We may update this Health Data Policy from time to time. If we make material changes, we will post the updated policy here and revise the "Last Updated" date above. We encourage you to review this policy periodically.
