AvalonBay Pet Rules and Emotional Support Animals

AvalonBay Communities publishes one of the more detailed pet policies among large apartment operators. It names restricted breeds, restricts several species outright, caps pets per home, and reserves discretion beyond the written list. What it does not publish anywhere on that page is a single word about service animals or assistance animals.

That absence is the reason this page exists. Everything below is quoted from AvalonBay’s published pet page, read on July 27, 2026. This is general information, not legal advice.

What AvalonBay publishes about pets

  • A two-pet cap. “Most communities allow cats and dogs and accept a maximum of two pets per home.”
  • A named restricted-breed list, which includes Pit Bulls, Rottweilers, German Shepherds and Doberman Pinschers among others, and closes with “All mixes of these breeds.”
  • Discretion beyond the list. “AvalonBay Communities reserves the right to deny residency to any animal deemed aggressive whose breed is not explicitly listed.”
  • Species restrictions. Beyond dog breeds, the policy restricts monkeys, ferrets, snakes, rabbits, livestock and reptiles.
  • Local variation. “Other pets may also be restricted. Please contact our community for details.”
  • Leash rules. Pets must be on a leash at all times when outside the apartment home.
  • The WAG program — pet play spaces, resident events, veterinary discounts through VCA Animal Hospitals and charitable giving.

Why the silence on assistance animals matters

It would be wrong to read the omission as a refusal. Large operators routinely keep the reasonable-accommodation process off the marketing pet page, and handle it through the leasing office, the lease addendum, or a third-party portal.

But it does have a real practical consequence. When the only published animal policy is a pet policy, the pet application is the only door you can see — and that door leads to fees, breed screening and a species list. Nothing on the page tells you a second door exists. So you have to ask for it by name.

Compare Greystar, which publishes the opposite: an explicit statement that assistance animals are not pets under federal law. Same industry, same scale, very different level of published guidance for a renter trying to work out what to do.

The three AvalonBay rules an accommodation request is aimed at

Each of these is a pet rule — a business policy the company sets — and each is a common reason an ESA owner gets stuck at an AvalonBay community.

The restricted-breed list

This is the big one. A breed list plus “all mixes of these breeds” plus discretion over anything “deemed aggressive” is broad enough to catch a very large number of ordinary dogs, including a lot of shelter mixes with no reliable breed history.

Breed restrictions belong to the pet policy. An assistance animal moving through the reasonable-accommodation route has generally not been screened against a breed list the way a pet is; the analysis turns on the individual animal, not on its breed as a category. That does not make an approval automatic — a specific animal that has actually behaved dangerously is a different conversation from a breed name on a list — but it is why breed alone should not be the end of your request.

The species restrictions

Rabbits, ferrets, snakes and reptiles are restricted under the pet policy. Federal fair-housing law is not limited to dogs and cats the way ADA service-animal rules are, so an animal outside AvalonBay’s pet list can still be the subject of an accommodation request.

Be realistic about the gradient here. The further an animal sits from a common household animal, the more the request turns on whether accommodating it is reasonable in that specific building — and the more your documentation needs to explain the need rather than assert it.

The two-pet cap

Pet caps are also a pet rule, but a second animal is a second request. Documentation has to support a disability-related need for each animal you are asking about, not just for the household. Our page on whether an ESA counts toward a pet limit goes into this in more detail.

What an approval does not change

An approved assistance animal is still subject to every rule that applies to every resident. The leash requirement is a good example: it is not a pet-only rule dressed up as one, it is a general control-of-animal rule, and it continues to apply. So do damage liability and nuisance rules. An animal that is genuinely out of control or destructive is a legitimate problem no accommodation cures.

On fees, the honest version rather than the confident one: an approved assistance animal has long been treated as not a pet, which is why pet fees and pet rent have generally not applied to one. HUD withdrew its assistance-animal guidance notices in September 2025 and issued narrower enforcement guidance in May 2026, so the federal enforcement picture is less settled than it was, while the Fair Housing Act itself, its reasonable-accommodation regulations, private lawsuits and state assistance-animal laws are unchanged. How to ask at an AvalonBay community

  1. Do not start with the pet application. Email the leasing office and ask, in those words, how the community handles a reasonable-accommodation request for an assistance animal.
  2. Ask whether a portal is involved, and get its name. If it is PetScreening or OurPetPolicy, read what they verify before you submit — both may contact the professional who signed your letter.
  3. Address the specific rule in your way. If it is the breed list, say so. If it is the species list, say so. A request that names the barrier is easier to act on than a general one.
  4. Do not lead with the breed. Lead with the disability-related need and the documentation. The breed question is theirs to raise.
  5. Keep the thread. Dates and written replies are what matter if this becomes a dispute.
